Scrap over petfood trademark put to rest : Petfood manufacturer Mars New Zealand
has come out top dog in a trademark scrap with rival Heinz Wattie's in the High
Court at Wellington. Justice David Collins overturned a decision by assistant
commissioner of trademarks Jennie Walden to reject Mars' application to trademark
the term "Advance Advanced Pet Nutrition" for its Advance petfood. Heinz
Wattie's opposed the application on the grounds that it already used the unregistered
trademark "Advanced Dog Nutrition" in marketing its Champ dogfood. Walden
had ruled the similarity of Mars' proposed trademark would confuse consumers.
